Course Overview
This programme provides specialised training in estate planning, focusing on the use of trusts, wills, estate administration, and the implications of the EU Succession Regulation (Regulation 650/2012 — Brussels IV) for both local and international clients.
The programme examines the legal framework governing trusts, probate, estate and succession in Cyprus, including the Cyprus trust regime, the validity and drafting of trusts and wills, forced heirship rules, probate procedures, and the administration of estates. It further explores cross-border succession issues, applicable law rules, and the role of the European Certificate of Succession (ECS).
Through theoretical analysis, practical examples, and case studies, participants will develop the skills required to design effective estate planning structures, identify legal risks, and advise clients with assets and family interests across multiple jurisdictions.
Training Objectives
Upon completion of the programme, participants will be able to:
Describe the legal framework governing trusts in Cyprus, including the Trustees Law, Cap. 193, the International Trusts Law 1992 (Law 69(I)/1992 as amended), and the distinction between local trusts and Cyprus International Trusts (CITs) and caselaw analysis.
Explain the formal requirements for a valid will under Cyprus law (Wills and Succession Law, Cap. 195), including the rules relating to forced heirship.
Describe the procedures for obtaining Probate and Letters of Administration and the administration of estates in Cyprus.
Analyse the jurisdictional and applicable law rules under EU Regulation 650/2012 (Brussels IV) and understand the role and function of the European Certificate of Succession (ECS).
Identify situations where conflicts may arise between Regulation 650/2012 and Cyprus domestic law, particularly in relation to forced heirship rules and immovable property.
Explain the use of Cyprus International Trusts as estate planning tools for international clients and understand their potential advantages.
Recognise estate planning challenges involving clients subject to sanctions regimes or exposed Cyprus trust structures.
Select the appropriate estate planning tool (trust, will, or a combination of both) depending on the client’s circumstances, objectives, and applicable jurisdictions.
Apply Brussels IV rules to determine the applicable law and assess whether an election of nationality law is beneficial.
Design basic estate planning structures for clients holding assets in Cyprus, other EU Member States, or third countries.
Identify legal gaps and risks arising from inadequate estate planning, including absence of a will, incorrect choice of applicable law, or failure to consider forced heirship rules.
Prepare practical checklists for clients involved in cross-border succession matters.
Address cultural and legal differences between jurisdictions when advising clients on estate planning strategies.
Recognise when collaboration with professionals from other jurisdictions is required through a co-counsel approach.
Appreciate the importance of regularly reviewing estate plans in response to changing regulatory, family, and personal circumstances.

Dr Chrysthia Papacleovoulou
Dr. Chrysthia Papacleovoulou is an Assistant Professor of Commercial Law at Open University of Cyprus. She had her LLB-Law from King’s College University of London, an LLM in Anglo-American Law with Commendation from City University London, and her Ph.D. thesis entitled “The Εmerging Global Corporation” from University of London, London Birkbeck College, with scholarship. She is an Honorary Fellow of the Association of Fellows & Legal Scholars of the Centre of International Legal Studies. She is a member of the Society of Trust and Estate Practitioners (STEP). She has taught, inter alia, business law, trust law, company law, tax law, international commercial arbitration and international economic law at private universities in Cyprus and business law at the University of Cyprus. Dr. Papacleovoulou‘s specialisation is on business law and she has given expert legal opinions before the High Court of London and International Arbitration Tribunals. Her research interests are focused on company law, cross-border disputes and the use of tax and corporate structures, trust law and international commercial arbitration with emphasis on Bilateral Investment Treaties Arbitration. She has presented papers at local and international conferences, and has published in international journals and book sections.
