Course Overview

The Markets in Crypto-Assets Regulation (MiCAR) establishes, across the European Union, the first comprehensive regulatory framework governing those crypto-assets and crypto-asset services that did not fall under pre-existing sectoral rules. At the same time, MiCAR’s practical application creates overlaps with other sectoral rules, such as those on payment services, and also raises policy concerns of systemic nature, particularly as regards the so-called ‘stablecoins’.

This practical programme provides participants with a structured and in-depth understanding of MiCAR, including the MiCAR provisions (Level1) as well as relevant Level2 measures and relevant guidance by ESMA, EBA and the EU Commission.

It will cover topics, such as scope and regulatory concepts behind MiCAR’s adoption, so-called ‘stablecoins’, including the recent phenomenon of ‘multi-issuance’, crypto-asset services, including their overlap with payment services and a presentation of the MiCAR review, currently under consultation.

By the end of this programme participants will be able to:

  • Familiarise themselves with the scope, purpose and practical application of MiCAR and the policy issues associated therewith.

  • Distinguish between the different categories of crypto-assets regulated under MiCAR and their delineation from instruments covered by other sectoral rules.

  • Identify the regulatory obligations applicable to crypto-asset issuers and Crypto-Asset Service Providers (CASPs) as well new business opportunities opened to CASPs by recent legislative developments at EU level

  • Assess the interaction and overlaps between MiCAR and other EU financial services legislation.

  • Gain a solid understanding of intended future regulatory developments on the basis of the MiCAR review consultation carried out by the EU Commission

    Konstantinos Kaniouras (LLB Athens, LLM Heidelberg, MBLT Mannheim, LLM Luxembourg/Strasbourg) Konstantinos is a lawyer, currently serving as Officer A' at the Financial Services Directorate of the Ministry of Finance (detached from CySEC). He was the national expert during the negotiations of MiCAR at the Council of the European Union. He also served as Chair of the Council Working Parties on the Asset Management and DLT Pilot files of the Market Integration and Supervision Package (MISP), during the recent CY Presidency of the Council of the European Union. He is also the author of the recently enacted Investment Fund Administrators Law.
