The risk-based approach is fundamental in the AML regime enshrined in the FATF recommendations and established in the EU. Applying this approach necessitates an understanding of the pertinent business-wide and individual customer, geographical, service/product, and delivery channel risks. CASP and CA-related activities entail typical business risks but, additionally, possess and present unique features that require bespoke consideration.
In this course participants will examine how CASPs need to implement the risk-based approach based on the leading FATF guidance considering the risk-based approach to virtual assets and virtual asset service providers (also known as crypto-asset service providers). Participants will understand the concept of a “risk-based approach” and how the FATF recommendations apply to CASPs. The course will focus on, the updated FATF Guidance for the risk-based approach for crypto-assets and crypto-asset service providers updated in October 2021, the latest guidance and reports issued by FATF, and the regulatory expectations from an EU law perspective
The course analyses the factors considered in conducting a risk assessment for crypto-asset activities and carrying out proper due diligence and the significance of travel rule. The course takes on a practical approach concerning AML programs underpinning crypto-asset activities that must reflect an effective and appropriate risk-based approach tailored to these activities.
