Course Overview
The Markets in Crypto-Assets Regulation (MiCAR) represents a landmark step in regulating crypto-assets and crypto-activities across the EU. Coming fully into effect in December 2024, MiCAR seeks to establish a comprehensive EU legal framework for crypto assets and crypto-asset services, expanding and encouraging the use of the distributed ledger technology (DLT), in the financial industry. MiCAR aims to regulate most crypto-assets currently outside of regulatory scope, expand the scope of crypto-asset service providers, and regulate issuers of crypto-assets. Its goal is to bring clarity, ensure market integrity, and establish a level playing field for financial industry activities involving crypto-assets and DLT, aligning crypto-asset markets with applicable financial standards.
This regulatory advancement is complemented by other important regulatory developments in the AML regulation of crypto assets. The EU AML Package comprises of separate AML EU legislations that address AML in a more harmonized and enhanced way, offering advanced tools to authorities to combat AML risks and covering more AML areas. In this context, the EU AML Package enhances the AML regulation of crypto-assets. The AML package intends to oblige providers of services concerning crypto-assets, defined more comprehensively in MiCAR, to comply with AML requirements. The AML Package together with MiCAR, is bound to create legal certainty, and enhance security regarding the use of crypto assets, increase the AML checks in the crypto-asset space, promote innovation and fair competition in the European financial market and bolster consumer protection and market integrity.
This highly researched and relevant course explores MiCAR as a key component of EU crypto-asset regulation. The course gives emphasis on what is being regulated and the key objectives under MiCAR.
